DO WE HAVE A REPUBLICAN FORM OF GOVERNMENT?

? DO WE HAVE A REPUBLICAN FORM OF GOVERNMENT IN TEXAS ?

Or has it been replaced with a form of authoritarianism. That is; a dispotic rule by government entities that are no longer accountable to any Law that secures Rights of those not in or part of government.

Our US Constitution makes this the LAW and imposes this DUTY on our Federal Government. “The United States shall guarantee to every State in this Union a Republican Form of Government”.

I contend that the Federal Government has been derelict in its duty. We no longer have a Republican Form of Government in the State of Texas.

Neither our Congress, nor our Texas State Legislature, nor the supreme court of either the United States or of the State of Texas has defined a “Republican Form of Government”. I want to pursue this issue in our Texas Legislature, our US Congress, and in our Courts right on up to the US Supreme Court.

Republican Form of Government Defined:

THE FEDERALIST PAPERS, Numbered 39, should be the first choice. But below see other authorities. An excerpt from The Federalist Paper #39 by Founder James Madison:

we may define a republic to be, or at least may bestow that name on, a government which derives all its powers directly or indirectly from the great body of the people, and is administered by persons holding their offices during pleasure, for a limited period, or during good behavior. It is ESSENTIAL to such a government that it be derived from the great body of the society, not from an inconsiderable proportion, or a favored class of it; otherwise a handful of tyrannical nobles, exercising their oppressions by a delegation of their powers, might aspire to the rank of republicans, and claim for their government the honorable title of republic. It is SUFFICIENT for such a government that the persons administering it be appointed, either directly or indirectly, by the people; and that they hold their appointments by either of the tenures just specified; otherwise every government in the United States, as well as every other popular government that has been or can be well organized or well executed, would be degraded from the republican character.

MY COMMENT: Those employed in our government in Texas consider themselves to be our nobles. They are tyrannical. They exercise oppressive power in conjuction with others who live off a paycheck derived from our Public Treasury. EXACTLY what Madison warned against. Providing the appearance of a republican form of government without the substance.

THERE are three species of government; republican, monarchical, and despotic. In order to discover their nature, it is sufficient to recollect the common notion, which supposes three definitions, or rather three facts: “That a republican government is that in which the body or only a part of the people is possessed of the supreme power: monarchy, that in which a single person governs by fixed and established laws: a despotic government, that in which a single person directs every thing by his own will and caprice.” –

MY undertanding of a ‘Republican form of Government’ – for Our Nation & Country – ALL Citizens are part of the “body” or “part of the people” possessing the supreme power. WE make the law through (1) our Constitutions, and (2) ancillary or law inferior to our Constitution through our elected agents in Congress & State Legislatures. In our Republic ALL people, as Individuals, have God-given Rights and LAW is for the purpose of securing those Rights from any and all that would deprive the individual of a God-given (inherent / inalienable) Right. Rights are not created by Law but are secured by Law from the government and the mop for the Individual. THAT is LIBERTY. AKA – The Rule of Law. and it is REPUBLICANISM. My experience with the government entity known as THE STATE OF TEXAS reveals we no longer have these in our State of Texas. Only the pretense thereof.
